Is Small Firm Really Unreliable?
In Japan, there are many big IP law firms having excellent experts in a variety of technical fields. As the law firm becomes larger, however, attorney who is substantially responsible for each case is frequently changed over a long period starting from the filing of patent application to the expiration of a patent, while the responsible attorney is apparently not changed in correspondence. In such case, we believe that individual attorneys tend to follow the consistency of firm's policy on how the scope of the claims should be designed in one patent application, which more or less compromises their own conscience of giving clients "truly beneficial" advices in every situation, and in some cases, compromises the clients' interests.
We believe that the individual attorneys, differing from members of a general business company, should defend their rights to autonomy and follow their own conscience, without being forced to be bound to the consistency of the firm.
